Facility & Park Rental

The Pavilion, Soccer Field, Basketball Court, and Park are available for reservations. The renter is required to be always present at the facility and available to District personnel during the entire course of the rental period. Renters using the facilities shall comply with all federal, state and local laws. Furthermore, Renter assumes full responsibility and liability for the acts and omissions of all invitees, licensees, contractors, vendors, guests, relatives, friends and their respective invitees and licensees with respect to the rental. All renters and residents must execute an updated wavier and accept the rules governing use of all district facilities.

Attendees who are ill or have been exposed to the Coronavirus shall not be admitted to event unless they are symptom free and/or have self-quarantined for at least 14 additional days.

The Southern Colony Recreation area is located at 406 Southern Colony Ave, Rosharon TX 77583. These facilities are available for private rentals and are managed by Fort Bend County Municipal Utility District No. 131. The rental agreement does NOT include splash pad rights. Reservations are only allowed between the hours of 10am and 8pm with a minimum of 2 hours. Reservations should include set up and clean up not to exceed past 8pm.

Park Policy & Rental Requirments

  • Applicants must be twenty-one (21) years of age or older. All applicants and contacts listed on application MUST submit a copy of their driver’s license.
  • Facility reservations and rentals are limited to individuals residing in FBCMUD 131 (members), MUD 189 and MUD 3 (non-members).
  • The applicant must provide the name and contact information for at least one (1) additional individual as a contact for the reservation.
  • The right to use of the facilities is exclusive to the applicant. The applicant shall not have the right to sublease or assign its reservation to another individual or entity; nor shall the use of the facilities be used for any other purpose other than what is stated on the FBCMUD 131 Facility Rental Application.
  • FBCMUD 131 (where appropriate) reserve the right in their sole discretion to not approve a FBCMUD 131 Facility Rental Permit Application or to revoke said permit based on good cause, such as the applicant’s and/or applicant’s guest(s) previous use history.
  • The renter on the contract must be present during the entire event. Please show your Driver’s License to the officer and or District Rep if asked.
  • It is the responsibility of the renter on the rental contract to assure attendees are following the guidelines and the event occupy rented space (s) only. Signs are placed all over the park acknowledging our rules, please familiarize yourself with them.
  • Paid rental time begins at 10:00 a.m. and ends at 8:00 p.m. Failure to vacate the facility by 8:00 p.m. will result in a charge of $45 per hour for residents and $55 per hour non-residents, deducted from the deposit.
  • Renters who fail to return the facility to the same condition as when they received access will have all or a portion of their deposit forfeited. Any damage more than the deposit will be the responsibility of Renter. District will provide a statement to Renter of any damages more than the deposit and Renter shall pay the invoice within ten (10) business days from the date of the statement.
  • Set-up, decoration, & clean up time needs to be included in HRS paid with a 3 hr. minimum rather than a maximum. Resident must handle loading-in and loading-out their own materials and trash.
  • All reservations are first come, first serve and accepted no later than 2 weeks in advance of requested date.
  • Cancelled reservations must be in writing and only accepted no later than 2 weeks in advance of requested date.
  • Refunds may take 4-6 weeks.
  • No alcohol, drugs, illegal substance, or guns are allowed on park premises. (including party vans).
  • The cleaning requirements include sweeping, taking out the trash, etc. Monitor trash levels and empty as needed to avoid overflow and spills.
  • No motorized vehicles allowed on park property.
  • All animals be on a leash on park property (Exception if in dog park area).
  • No glass bottles allowed on park premises.
  • Security fees are the responsibility of Renter and are made payable separately to Shield Guard, LLC. The number of attendees will determine security requirements. The Security Officer and/or Law Enforcement Officers have the right to end an event at the discretion of the officer.
  • Programs conducted by the district will be given priority over any reservation requests. The district reserves the right to cancel any reservation that may conflict with a District sponsored event or activity. Every effort is made to minimize and/or eliminate the likelihood of such an occurrence.
  • Residents are given priority over non-residents.
  • All decals and keys must be returned to the officer on duty at the end of your event. No exceptions.
  • Absolutely no fireworks are allowed on FBCMUD 131 Park property. Without the written consent and approval of FBCMUD 131.
  • Liability insurance for events open to the public is required and the responsibility of Renter. A certificate of insurance must be presented to FBCMUD 131 before a public function can be held. Requirements for liability insurance will be set by FBCMUD 131 and must name FBCMUD 131 as additionally insured.
  • Upon the conclusion of any rental, a FBCMUD 131 Representative will inspect the condition of the premises and verify that the premises have been left in the same condition as received. A final rental report form will be completed to acknowledge that all rental responsibilities have been met and that a deposit or a portion thereof, will be refunded within 4-6 weeks.
  • Any inflatable jump/bounce houses will be used at Renter and guest risk. FBCMUD 131 will not be responsible in any manner for any injuries sustained from any use or installation of inflatable jump/bounce houses. (No Water Bouncy Houses)
  • Food Truck parking begins 20 feet from driveway entrance to park and limited to 5 food trucks. ($30 CLEAN UP FEE)
  • All rentals for outdoor facilities include the inherent risk of weather-related cancellations and/or delays, and the renter understands and agrees. However, in the event of extreme weather the district may consider a reschedule date on a case-by-case base.

Hold Harmless Agreement

Renters shall be fully responsible for all activities occurring on the premises under this agreement during the rental period and shall hold the district and its agents free and harmless of any damage or loss of personal property or any bodily injury suffered for any reason during or as a result of a rental. By signing this agreement, you acknowledge and understand that your period of responsibility begins once you enter the property and/or once your rental time starts, whichever comes first, and does not end until you and all your guests have left the District’s property. If a person at your rental causes any damage to property, and/or bodily injury, and/or harm to him/herself and/or any other person, while located on or off the district’s property during or following your rental as a result of consumption of alcohol at your rental, you understand that you assume full and total responsibility for their actions and agree to hold the district and its agent harmless.

Binding Legal Contract

The rental requested agree that the facility rental terms are in accordance with the terms of the Rental Policy and Fee Schedule, a copy of which has been provided to me.  Any disregard of the Rental Policy, on my part, will result in the need for Board approval if I wish to rent the facilities at a future date, or inability to rent the facility depending on the severity of misuse or damage. I understand I will be charged for any damage that occurs by anyone while I am renting the facility. I acknowledge that I forfeit my deposit and must immediately pay the district for any damages or cleaning expenses that exceeds my deposit and that failure to pay can result in a lawsuit being filed against me.  If I am sued for damages, I agree to pay all legal fees and court costs associated with the collection of this debt. I fully understand and agree to the above hold harmless agreement. I agree to hold Fort Bend MUD #131 (hereinto referred to as “District ”) and its agents free and harmless from any negligence, and/or act, and/ or failure to act. I further agree to hold the district harmless for any act of a third party, and any cause of any action arising on the district’s property. I understand and agree to be personally responsible for any damages and/or bodily injury to myself and/or any individual/guest on the property during or following my rental period until all individuals, including myself, have left the district’s property.
